Key legislation: financial services
With the destructive impact of weak and fragmented financial regulations on economies of the EU member states in mind, the EU has adopted three new regulations on financial services in November.
The Regulation on Credit Rating Agencies sets forth new stringent requirements that those agencies have to fulfill in order to be able to issue credit ratings.
The Directive on UCITS (Undertakings for Collective Investment in Transferable Securities) establishes rigorous authorisation requirements on UCITS prior to pursuing any activity.
The Directive on Taxation of Capital Gains stipulates that cross-border mergers and divisions shall not give rise to any taxation of capital gains based on difference between real assets and liabilities transferred.
